WE PROVIDE FULL SERVICE LEGAL REPRESENTATION to federal and postal employees—in Southern California, Southern Nevada, and Arizona—before the Merit Systems Protection Board, including appeals of adverse personnel and disciplinary actions such as denial of promotion, discriminatory performance appraisals, improper reductions in force, removals and suspensions in excess of fourteen days.
The Merit Systems Protection Board (MSPB) was created to protect federal employees (and some postal employees) from being improperly demoted (including a step or grade change), suspended, reprimanded, or fired.
Although, theoretically, the rules governing the MSPB are supposed to be so simple that you can represent yourself with ease, in actual reality the rules have grown increasingly more complex with the passage of time. As a result, the employee who represents himself or herself is normally at a considerable disadvantage, especially given that federal agencies are normally represented by attorneys in MSPB cases.
Given the complexity of MSPB law and procedure, most employees quickly find that it is wise to be represented by an experienced attorney.
We can represent you throughout the entire process by:
· Filing your initial complaint to the MSPB
· Reaching an ultimate determination at the MSPB
· Appealing unfavorable decisions—all the way to the United States Supreme Court if necessary
· Managing alternate dispute resolution procedures. such as mediation or arbitration
If you have been subjected to an adverse or disciplinary action, you must act quickly. You have only thirty days to file your appeal. Barring extremely exceptional circumstances, if you miss the filing deadline, you will not be allowed to file. You will be denied any right of appeal. So, even if you are waiting for a grievance or whatever, do not delay. Act now.
